1. TERMS AND CONDITIONS OF PURCHASE

Please read these Terms and Conditions of Purchase carefully before ordering any Online Products from the Website.

WHEN THE TERMS AND CONDITIONS OF PURCHASE APPLY
When you place an order on the Website to purchase one of our products (“Products”), you fully accept and agree to comply with these Terms and Conditions of Purchase and Terms and Conditions of Use.
If you do not agree to one or more of the terms or conditions set forth in these Terms and Conditions of Purchase, please do not purchase any Products and contact our Customer Care Team.
The Terms and Conditions of Purchase are identical in all Countries in which the Website operates.

WHO CAN PURCHASE PRODUCTS ON THE DUNCAN AND NAMARA WEBSITE?
Our Website is for final consumers only.
You must be at least 16 years old to purchase Products from the Website.
You may make a purchase whether you are a registered user or a guest. If you are a registered user, the order will be made simpler by using data already recorded on our system

HOW TO PURCHASE PRODUCTS FROM OUR WEBSITE
On our Website you will be able to view the Products for sale and all information about the Products. When you choose a Product, you will need to complete the order form and submit it in accordance with the instructions on the video that appears. Submission of the purchase order constitutes an offer to purchase the Products listed in the order and an acceptance of these Terms and Conditions of

Purchase and of the Privacy Policy. The purchase offer is binding on you from the moment you submit it and therefore you will not be able to cancel it. However, you have the right to withdraw from the purchase within 7 days from delivery.

CHANGING SIZE OR COLOUR
We are sorry, but the order is processed immediately after submission, we cannot change sizes or styles. If you wish to change a Product, you will need to return it and make a new purchase.

ORDER CANCELLATION
Since the order is processed within one hour of submitting it, it is impossible for us to cancel it.
If you notice an error, you can contact our Customer Care Team within 60 minutes from placing the order and they will try to assist you. Please take note that Customer Care service is only available at certain times.

PRICE
The prices indicated are inclusive of VAT.
Notice: We reserve the right to change the price of the Products and to change, limit or end any special offer, promotion or discount on the Products at any time.
Special promotions and sales may also depend on the selected Country.
When you place a Product in your shopping cart, but have not yet submitted your order, you have not confirmed the purchase contract. We encourage you to always check the price before submitting an order, because the price may have changed.
Notice: Prices vary from Country to Country, also due to the application of different VAT rates in the various countries. We are required by law to apply the VAT of the Country of destination, so the final price including VAT may be recalculated on the basis of the Country where you have requested delivery.

Prices may also vary during official or customary sales periods in some Countries or in promotions for some Countries.

DELIVERY: DESTINATIONS, TIMEFRAMES AND COSTS
To ensure you have the best service, we will only send by Royal Mail or DHL.

You will be able to track the shipment using the tracking number that will be provided to you by email.

Your order will be despatched within 28 days of ordering. Shipping will be Free of Charge to all destinations.

We will deliver within the time frame that you will find in the order, or within 30 days at maximum, and to the place you have indicated; please be advised that we are only able to deliver to private residential and/or office addresses. We are not responsible for delivery to individuals not authorised by you. If you have purchased several Products, we may make partial deliveries so that you receive the delivery as soon as possible, without charging you additional costs. In the unlikely event that it is not possible to deliver the Products ordered within the prescribed time frame for reasons beyond our control, we shall promptly inform you and reimburse your payment. In this case, the purchase contract shall be understood to have been terminated. Each individual delivery shall constitute a separate contract of sale. In the event of a delay in a delivery or a failure to deliver a Product, in the case of purchases involving several Products, you will not be able to cancel the order for the other Products.

PACKAGING

As a brand, we are environmentally conscious in everything we do. For this reason we keep packaging to a minimum whilst ensuring that your items are fully protected on their journey to you.

SCHEDULING DELIVERY
The ability to schedule a delivery depends on the courier service. We will notify you of the chosen courier service when we send you an order confirmation, and you may contact them directly. Some couriers require a fee for scheduling a delivery.

DELIVERY ATTEMPT
If the courier service does not locate anyone who can accept the delivery, they will leave a notice indicating whether they will attempt the delivery again or where you can collect the package.

DELIVERY NOT COLLECTED
Uncollected Products shall remain in storage until the deadline set by the courier service. You can check this deadline on the courier service’s website.
After this deadline, the courier will return the Products to us.
Once the Products that you have not collected have been returned, we will credit you using the same payment method you used, less shipping costs and storage costs.
We will send you information regarding this matter to the e-mail address you entered in the order.

PAYMENT METHODS

We wish to inform you that we verify your preferred method of payment for each purchase, in accordance with our Privacy Policy. Based on the results of the payment verification, we reserve the right to reject certain payment methods.
If your credit card is close to expiry, we may ask you to enter a new one.
Payment can only be made in the currency displayed on the order. Any currency conversion will be implemented by your credit card provider.

SECURITY FOR PAYMENTS WITH CREDIT CARDS

Duncan and Namara is very attentive to its Customers. Duncan and Namara has activated fraud prevention services using the credit card processing circuits.

TRANSFER OF OWNERSHIP OF THE PRODUCTS

The delivered Products will remain our property until we collect the relevant price and shipping charges specified in the order form. However, the risk that the Products are lost or destroyed remains with us until they are delivered to the location you have indicated.

GARMENT CARE
Follow the instructions on the care label in garment :

Knitwear : Extra fine merino or Cotton  - machine wash cold on gentle cycle and do not tumble dry.  

All other garments Dry clean only.

RIGHT OF WITHDRAWAL
You have the right to withdraw from this contract within fourteen (14) days of delivery without being required to provide reasons. We will ask you if you want to inform us of the reason for the sole purpose of improving our service, but you are free to not answer.
In the case of several Products ordered in a single order and shipped separately, this time period is calculated from the last delivery.
To exercise the right of withdrawal, you must inform by sending a document (e.g. a letter sent by post, a fax or an e-mail) stating that you wish to withdraw from the purchase contract.

CONSEQUENCES OF WITHDRAWAL
If you decide to withdraw from the contract, all payments made will be reimbursed. The same payment method chosen during the initial transaction will be used for reimbursement.

RETURNS AND REFUNDS

If you are not completely satisfied with your purchase, you can return one or more articles within 14 days of delivery of the order. The article must be returned in the same conditions in which you received it; unworn and with all the security tags still attached on the front and back of the garment, and in a single box. We will gladly offer:

  1. Exchange the goods.

  2. A Credit Note.

  3. A full refund.
  4. Credit note or exchange on sale items. No refunds on sale items.

INSTRUCTIONS FOR SHIPPING A RETURN

Returns:
• - Package the articles carefully in the original order packaging,

if possible, otherwise use appropriate packaging.
- Return via DHL couriers or the Post Office : signed for and tracked service.

Orders are shipped delivered exclusively on weekdays during office hours, from Monday to Friday, excluding national and local holidays. On other occasions, such as holidays, the processing times may be slightly longer.

Please remember that the order shipping address must coincide with the country selected to browse the website. You can change the country on the menu on the bottom left-hand side. The shipping address cannot be changed once the order has been made.

All orders are processed automatically and we cannot alter the shipping and delivery times.

* Please add an extra day for delivery for orders from remote areas. The shipment times are calculated from the moment when the order is delivered to the courier.
